A pharmaceutical company has been fined €3.2bn after it pleaded guilty to selling a medicine containing the active ingredient in the popular weight loss drug Xenical, which was marketed by Roche.
The company, which is based in Dublin, Ireland, had pleaded guilty to a criminal offence for marketing a fake medicine which contained hidden drug ingredients.
The company, which was acquired by Roche in 2001, was also involved in the marketing of Roche’s weight loss drug, Roche-FX. The company’s marketing department discovered that Xenical was not being used by a patient and was being sold on its website without his knowledge.
The company was also involved in the illegal sale of the drug, which had been advertised on a web site and which was hosted by an unknown hosting company.
Roche pleaded guilty to the criminal offence, admitting that they had been selling Xenical without his knowledge. The company said that its product was not intended for medical use.
